Can my children force me into a nursing home?

When seeking out long-term living arrangements, the decision touches on a delicate intersection between finances, health, family dynamics, and personal preference.

Often the situation can be compounded by an unwilling loved one who is not agreeable to entering a nursing home.

But the question remains, can someone force you into a nursing home?

If you are of sound mind and have not been declared incompetent by a Physician, then it is unlikely that you could be forced into a nursing home.

However, if your mental capacity is diminished or you require a high level of care, a Guardian or Conservator, could be appointed by the court to act on your behalf. Only then could a Guardian or Conservator place you in a nursing home for your safety and wellbeing.
